Bank statement for maintenance - moved money between accounts

Post by goldsurfer » Tue Aug 28, 2018 9:21 am

Hello Admin (s),

I am applying for T2 G - Dependent visa for my child born in the UK recently. There is urgency as I need to travel to home country in Nov last week.
My question is regarding proof of maintenance funds for dependent:

As per https://www.gov.uk/tier-2-general/family-members
The requirement is to show 630 for dependent and 945 for myself. It is also mentioned that
"You must have proof you have the money, and that it’s been in your bank account or your dependent's bank account for at least 90 days before you or they apply."

In my case, the money was present in my wife's account (as savings) from 90 days, BUT we moved it to my account on 22 August via bank transfer.

If I present bank accounts for both of us and provide a letter explaining this , would it suffice?
Transactions are clearly visible and can be linked.

Tier 2 dependent visa

Post by goldsurfer » Mon Sep 03, 2018 11:36 am

Hi,

I am currently preparing T2G dependent application for my child who is born in UK last month.
I only have maintenance funds as savings in my wife's account from last 1 month. I intend to travel to home country in 1st week of Nov so there isn't enough time to satisfy 90 days maintenance rule.

My question is: Guidance says that Maintenance letter from A rated sponsor should be good if I cant show personal savings. But my sponsor is now saying that with maintenance letter, visa will get rejected as it is in country application.

Can you please advice if I should go ahead with maintenance letter from sponsor? Or there has been any such posts in this forum where dependent visa got rejected because of use of maintenance letter?

Thanks

Hi Admin,

There is a lot of confusion around maintenance and it is building up everyday
Can you please help me?

1. For T2 dependent visa for my child, do i need to shoe £630 as maintenance or £630+£940 for me? (I already have visa valid till ILR)

2. My employer is ready to provide letter for maintenance but he feels that Visa will be rejected as letter of maintenance is only good for applications made out of UK. (Has anyone ever denied visa because of using letter of maintenance while applying for dependent inside UK?)

1. You need to show £630 for EACH dependent for 90 days.

2. Your 'sponsor' cannot certify maintenance as this is not possible once the main PBS visa holder (the sponsored employee) has obtained ILR as you are no longer a sponsored employee.

Thank you very much CR001,

I am not on ILR, still on Tier 2 general. Will maintenance letter from A rated sponsor suffice?

Also while filling form for the child, There is a question asked: Has sponsor certified maintenance? if i select 'yes' then in supporting documents i am not asked to provide any proof of maintenance. Please advice.

Further to my question, in PBS dependence guidance
https://www.gov.uk/government/uploads/s ... 7-2018.pdf

It is mentioned in point 83:
83. If you apply separately from the main applicant you will need to have the necessary funds to meet
the maintenance requirement or have a written undertaking from an A-rated Sponsor, unless the
main applicant already had leave in a Tier 2 category and when applying for their most recent period of Tier 2
leave was not required to show evidence of satisfying maintenance requirements.

When I applied for extension, along with my dependents (wife and 1st kid) i wasn't required to submit any proof of maintenance. My sponsor has informed me that neither did they provide maintenance letter (to the solicitor who processed our application extension)
Solicitor has advised that it is a straight forward application for my new born and I do not need to show any maintenance proof.

Is he right if we look at point 83? or I have misread the guidance? :?: :? :?

Documents I provided: Full birth certificate and passport.
even passport is not mandatory.
