Hi Guys,

A query regarding an employees as I was granted extension in Oct and since then Employee A is still working however Employee B left after 6 months of my extension granted and then hired replacement after 4 months and Employee B continued till June 19 and then again hired Employee B replacement from this month my question is for Employee B I will send 6 months RTI after extension and then after a break of 4 month I will send replacement employee's RTI for 8 months and 1 month of July for again replacement of employee B.

But what about Employee A as Emp A working since extension granted no break or anything so how I am gonna send his FPS RTI, is same as employee B's FPS RTI e.g. same months with break or I can just send FPS RTI for employee A for last 12 months from July 19 backwards. Kindly advise
Dont confuse yourself between employees and jobs. Note the requirement is 2 FT JOBS not employees. So you have to provide 12 months RTI FPS for each job. Employees can come and go. As long you have 12 months RTI FPS for each job your are good.
JOB 1 with employee A seems continuous so provide 12 months continuous RTI FPS
JOB 2 provide 12 months RTI FPS. Gaps dont matter. Note you will need passport copies of all employees who fulfilled the job roles.
Thanks Tier11417,

So I will send Employee A FPS for July 2019 to backwards for 12 months and same backward for Employee B doesn't matter the break as long as 12 month completed

Can I create a dummy account just to get an idea so I don't make any mistake in actual form ?

Do I need to upload docs myself or after submitting form I need to book an appointment with Sopra Steria they will upload the docs on my behalf ?

Hi Tier11417, Aman or any other senior member could reply on above query please. Thanks
Couple of more question I just saw a form and it was asking below; could you please share your experience

1) What date did you begin submitting Real Time information to HMRC?
(Real time reporting introduced by HMRC in April 2013 and required employers to comply with PAYE regulations by sending Full Payment Submission to HMRC in Real Time) and then asking for date/month/year
so what date I should put here the very first date when I hired my first employee after Tier 1 Ent visa granted ?

2) Do I need to tick on below point in the form
Employee Payment records original HM Revenue & Customs P45 or P46 (as I am sending FPS/RTI and payslips anyway) do I still need to send P45 for employee who left after the extension period ?

3) In job section they asking for date when the job was created (does it mean I need to put the date when the job was created which was before extension period and after approval of initial Tier 1 Ent)

Yes you can create a dummy account.
You can upload yourself after you pay and the system will direct you to the sopra website. You will be able to upload docs and book an appointment there.
You can upload yourself (recommended) or sopra can upload for you for an extra fee. Tier 1 Ent docs are quite a lot so normally the sopra staff gets annoyed or does not upload all as some members reported so best to upload yourself before appointment.

Thanks for your response, I will upload by myself is there are section to upload the docs or you can just upload as many docs you have in one section. Furthermore, do I need to send accountant letter or employees working hours statement on accountant letter as I sent in my extension application or any marketing material like website leaflets business cards and insurance documents ?

Where do I need to mention my absence as I was away for 2 weeks after first grant of Tier 1 Ent and then I was away for 3 weeks after extension all together I was absent from UK 5 weeks in 5 years on Tier 1 Ent visa

Furthermore they are asking if I have ever been refused visa for any other country I was refused 3 times from Ireland before coming to UK in 2010 do I need to mention this on my application and what reason I should put as I don't have the refusal letter as well.

I was also rejected US visit visa in 2015 do I need to mention this as well in my application. Kindly advise

1. There is a section on the form where you are expected to enter ur absences during the 5 years.
2. Yes. You should mention all refusals. It’s unlikely to impact the decision.

1.Did you join a new business after ext? If not then No.
2. You can mention hours without involving accountant on a plain paper.. if there are a number of changes.
3. Ur prerogative.. marketing material otherwise not required at this stage

Thanks for your response no I didn't join any business so I will not send any accountant letter.
Yes one employee hours changed during the employement 130 to 170+ and then back to 130 does it effect on application or do I need to mention this in seperate sheet
I will send business insurance documents and website print and leaflet and business card as well

As long as you submit proof of 2 FT JOBS min of 30 hours/week it does not matter if hours are decreased or increased over that requirement.
Extra docs are not advisable. What business insurance you have? These documents are not required only optional.

I agree with tier11417.. HO will do their due diligence of the company regardless of what you send.. they’ll simply google your business.
Focus on ur overview of business, directors role and employees job description.

Thanks guys for your replies.

I have Professional indemnity, employers liability and Indemnity.

Sorry I am asking the same question again, as I am eligible to apply in Mid august if the count initial grant of tier 1 ext visa however I got dependent with me and she can't apply before September. My question is would it be wise if I apply both application separately or shall I wait till September and send both application together. Kindly advise

Personally I want to apply separate just don't want to create the mess in regards to docs.

Do I need to mention in my application that I will be applying for my dependent visa in next month ?

Apply separately! Focus on ur application. And don’t needlessly delay ur application.
It’s not like ur saving on the fee
.

You only need to add cohabitation documents.
Documents can be uploaded till SOPRA appointment.

Wouldn’t think so

PBS Dependant eligible for ILR= 07/07/23 minus 28 days
ie 10/06/23

She ll need two extensions till she reaches the qualifying period if I’m not mistaken.

The second maybe be avoided if timed appropriately 🤷🏻‍♀️ Ext nearer to expiry- delayed biometrics
But it’s a stretch..rules can change and you guys may need to travel..

Payslips of both employees 12 months (1 job cont since extension and for 2nd Job I hired total 3 employees do I need to send their P45 who left the job and P60 and P46 ?
Employees status in UK e.g. Passport / ILR coplies
