Yes you can apply upto 28 days before expiry. Online application date will be application date. Just dont apply on the edge as in to make sure to apply in time so I would say just apply 25 days before expiry.

Ok. You have time to go then..
and hence you need to make ur own notes and discuss ambiguities with the forum.
You and your dependants timeline, absences and job creation is the most crucial. So better write a single post stating those so we don’t go back n forth and employ assumptions.
Right now the guidance is more clearer than the earlier ones. But HO tends to update the guidance so keep ur self abreast regularly. Frequent the forum nearer to time.
I took the postal application so my questions were different.
Run a dummy application so you get the feel of it.

Please have a look on below list of documents for Tier 1 Entrepreneur to ILR application with dependent, her visa is also expiring on same day with me.

Main Applicant (Tier 1 to ILR)

Current Appointment Report
2 Years annual accounts (Extension period)
CT600 of both years
12 month Pay slips of both employees
P45 of one employee who left during the period
P60 of the employee who left
Full RTI Submission of 12 months
Both employees Passport or ILR card copy
Letter from bank stating that I am the sole signatory (no bank statement)
Life in the UK
Master’s Degree
Cover letter
Passports
BRP

I am also taking out salary from my business account, question is do I need to send my personal bank statement or pay slip as its already covered in RTI as I didn't send it for my extension as well.

PBS Dependent Documents:

Marriage Certificate
Joint Council tax bill
Joint water bill
Maintenance £630 for 90 days (is it required?)
Flat / House agreement (is it required?) if its required shall I get her name on contract or not?

Could you please have a look and confirm if I am missing out any necessary documents in above list.

No maintanence required for ILR. But for now you are applying her PBS dependent where it is required.
You have to apply online, book an appointment via sopra steria UKVCAS centre to provide docs and bio in ILR case. No postal in ILR case. I am not sure if there is any postal for PBS dependent you have to check on gov website.

One more thing one of my employee I am paying £9.20/- hourly rate and she is doing 173 hours monthly. Is that ok ?

Furthermore, from Jan 19 her tax code has been changed now as per HMRC as she started another job. Will it effect on my application or shall I reduce her working hours from 173 to 120 hours monthly which means 30hrs per week.

Do you run your payroll monthly or weekly? Its safest to assume 130 hours per month if the payroll is run on monthly basis as it calculates to a total of 1560 hours per year that is HO requirement.
The guidance only states 30 hours/week.
As not all months are equal 30 hours/week comes to a minimum of 120 hours a month and some months will have more hours to make up the rest for a total of 1560 hours/year (this is personally my case).

But I would advise you to be safe and have atleast 130 hours a month although the online application form says 120 hours to be fulltime also. But just for you to be safer 130 hours/month will be better.

You can send payslips printed 160 hours or whatever HO is conerned for a min of 30hours/week, rest is disregarded.

Alright thanks and yes I run my payroll monthly basis so will do 130hrs does it necessary to keep both employees till I apply for my ILR although they have completed their 12 months employement with 130hrs monthly.

There is no requirement for employees to be active at application date as long you have fulfilled your job requirements. It really depends on what your business needs are.

Furthermore, I travelled back home for 2 weeks in my initial visa and 3 weeks after extension. Do I need to mention that or they will check via my passport stamp.

Thanks for your reply Marcnath, is there anything I am missing out. Can I create a dummy account just to get idea of ILR online application form so when filling the original one I make no mistake. Is it possible ?

Yes you can create as many dummy accounts you want. The online application is pretty straight forward to run through. I usually run a dummy application in 10 minutes. The application is not sent untill you pay and submit. So you will know all the questions and can view the checklist also.

Hi Guys,

What I've understood that people having problem applying via sopra and still confused is it possible if you still can apply via post same as old like fill the form online take print out and send it over will all docs. Kindly advise.

No you must apply online as old forms have been removed. There is nothing confusing about it, it is very straightforward

One more thing I was granted extension in Oct 2017 and my employees were working with me since then however one employee left in April 2018 and hired new employee in Sept 2018, so it will be ok if I send both employees (old and new) payslips to cover 12 months period after extension.

Btw I was granted initial Tier 1 in mid of september 2014 and extension granted in Oct 2017, so am I eligible to apply 28 days before in Sept 2019 e.g. last week of August.

My wife granted her visa as a dependent and valid till Oct 2019 would it be ok if I apply my visa in August alone and apply for her visa in end of Sept seperately ?

Would it be ok if I only send 2018 accounts with CT600 and CAR to cover HMRC and Company house confirmation ?

Anyone can share their experience regarding subjected queries.
