In my honest opinion, taking into consideration the 'dubious' practice of the previous employer's tax avoidance, it may be wise to wait until your husband can submit financial evidence of earnings from his new contract.

In making your decision however, you will need to weigh the pros and cons for delaying and taking your chance with the SS route still being open.

Edit: By the way, I'm aware of Spain's 'interesting' approach to financial dealings....my husband and I lived there for a few years.
That's exactly what I was thinking. I'm hoping we'll be able to apply around January and hear back in February so we'll be in the UK before Brexit. I know that's cutting it close but I'm not sure what else we can really do at this point.

Thank you so, so much for your help and advice. You have no idea how much you've helped us! Where did you live in Spain? How long were you here?

Alright, I really need to stop bugging you, but I've got one more question! As far as supporting documents go, we don't have a lot of money to pay for translations, so I want to be smart about what we submit. I know we need to show evidence for the whole period we've been here... are we talking one letter addressed to each of us per month? I was also planning on submitting some utility bills, so do I need to submit all of them or just a couple? We've got a lot of evidence since we've been here for two years but I don't want to submit too much! What would you recommend?

I know I mentioned this earlier, but this is what I'm planning on submitting. Is there anything you'd add or remove? I've put a :?: next to things that I'm not sure how many we need/from what dates:

Personal info:
- both of our residency cards (his from Feb 2018 and mine from June 2018) with our address on it
- passports
- marriage certificate

Living situation:
- lease (only has his name on it)
- letter from landlord saying how long we've both lived here
- certificados de empadronamiento
- photocopies of my student residency cards (valid from Dec 2016-2018) with our address on it
- :?: utility bills -> one in his name and one in my name
- :?: various letters sent to our address: to me from Spanish government, to him from landlord, his student loan letters from UK, my health insurance, my payslips etc.

Financial situation:
- :?: joint bank account statements (these are already in English!)
- part-time work contracts for him (starting Sept 2016) and for me (starting January 2018)
- :?: his payslips
- vidas laborales
- social security numbers
- apartment lease (with only his name on it)

Other center of life:
- my private Spanish health insurance
- our cards showing registration at the local health center
- certificate of attendance from the TEFL course we met on
- library cards from local public library
- 10ish pictures of us over the last two years in Spain with his local family and our friends, England, and the US
- cover letter explaining our situation/with table of contents of supporting documents

I would include everything you've listed, apart perhaps for the UK student loan letters.

3+ years in Spain, inland south of Valencia...husband longer.

Nice! We're living in Valencia as well.

Okay then, so how many utility bills/payslips/bank statements would you suggest?
