UK Spouse Visa Extention

Hello There,

I am a British Citizen and hoping to get help with few spouse extension visa question.

My wife came to UK in 2016 with a spouse visa for 2.5 years. At that time we had met all the requirements such as annual income and passing IELTS. Now, its time to apply for visa extension. At the moment we do not meet the financial requirement as I am in full time education. Also, we did not realize she had to pass IELTS again as she had passed at B2 level before she entered UK in 2016. However, my wife has passed GCSE English in this 2.5 years time with grade C. When I looked around for information to apply for an spouse visa extension, I found out that we can apply thorough 10 year route if we do not meet the requirements.

Now my question is if we apply through this 10 year route now, will we be able to add those 2.5 years that she spend already to make upto total 10 years when we apply for Indefinite Leave to Remain in future?

If your partner working then her income can fulfill requirement. Otherwise if either of you or jointly hold 6 months old savings of at least £62500 then can meet financial requirement through saving instead working. If not then may apply under 10 years route but for qualifying ILR new clock will restart by excluding the previously spent time of 2.5 years.

Yes the 2.5 years will go towards 10 year ILR route.

Your wife having done B2, should be able to pass B1 relatively quickly which will see her through to ILR
