Registering children born outside UK for BC - without parents

Post by edek130 » Tue Sep 25, 2018 11:39 am

Hi,

I have a wife and two children and I’d like all my family to have BC eventually. We’re from EU – children were both born in Hungary. My wife and children all have had permanent residency since 2016.
Due to cost reasons I applied separately last year and was successful. I want to apply for both of my children as the next step but I’m not sure whether I can do that without my wife applying at the same time?
The guidance is not very clear on this point. My wife will apply as well but at a later date.

I started on the online application form but not sure which section to select:
One or both of your parents is applying for British citizenship – for me it would make sense to choose this option but not sure as my wife wouldn’t apply at the same time.
If I do choose this option the next question is the following:
Are either of the parents of the child (as stated in this application) applying for naturalisation as a British citizen on an AN form? – the answer would be no.

Has anyone attempted to apply for the children separately?

Any advice would be appreciated.

Many thanks

You can apply for the children if you are British and the other parent holds PR.

Should not be an issue at all, many have done this.

Many thanks for the quick reply.
Is the below section the correct one to apply under?
One or both of your parents is applying for British citizenship

We (me) don't have access to the online form. What other options were given prior to this on form MN1?

It would not be correct if the other parent is not applying.

pls see below the options listed on the form

You were born outside the UK
• Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born
• Your parent is British by descent and you and your parents (unless they are legally separated) are now living in the UK or a British Overseas territory
• You were born on or after 13 January 2010 and your parent was serving in the UK armed forces
• You were adopted abroad by British citizen parents
• You were born before 1 July 2006 to a British father and your parents were not married
• One or both of your parents is applying for British citizenship
• Other - apply at the discretion of the Home Secretary

I'm guessing I'll have to put it under the discretion of the Home Office then

It is 'OTHER' as they are applying under section 3(1) of the nationality act which is an application at discretion of the home office.
