FLR(FP) - More time

Hello everyone

Me and my girlfriend have been living together for about 15 months. I'm an EEA national and she is from outside Europe. We have all the required documentation confirming our relationship. The problem is that we haven't lived together for 24 months required to apply for Unmarried partner visa.

We plan to apply for Futher leave to remain FLR(FP) in order to get more time. It'll take anything between 3-8 moths for the application to be processed. In the meantime we are going to live together and before the application is refused (which will obviously happen) we will apply for unmarried partner visa.

Is this a good option to follow?

She's in the UK on student visa. Will this application not prevent her from applying for another student visa in the future?

Your plan to apply flr fp won't work because its under uk immigration law whereas you are an eu national. Best is to marry her and apply 5 years residence permit.

I have permanent residency in the UK. So we will be applying under the British law. Sorry forgot to mention that.

Unclear from your post if you have lived together at all, please clarify??

When does her tier 4 visa expire?

FLR(FP) is not the correct application and will likely be refused very quickly as it is a 'frivolous and vexatious' application purely to 'buy time'.

As you are an EU citizen, you can still use the EEA route for your partner, provided you meet the 2 years living together and have proof.

Her Tier 4 visa expires on the 20th October.

How quickly can it be refused? And will this "frivolous and vexatious" application not have any negative consequences for us?

We haven't been living together for 24 months so we can't use the EEA route.
