spouse visa using cash saving as a financial requirement

Post by ADAM2018h » Tue Oct 02, 2018 2:31 pm

Hi experts/advisers,
Thanks a lot for your support

I am a British citizen and my husband is an international student holding a Tier 4 visa studing PhD in UK. I do not work at the moment. we are aiming to use our saving as a financial requirement to switch his visa from Tier4 to Spouse visa. As you all know that the imigration rules was updated on Aug-2018. The question is, on top of the 16,000£ How much additional saving needed, can anyone please clarify these sections to me:

(b) specified savings of-
(i) £16,000; and
(ii) additional savings of an amount equivalent to 2.5 times the amount which is the difference between the gross annual income from the sources listed in paragraph E-ECP.3.2.(a)-(d) and the total amount required under paragraph E-ECP.3.1.(a);

E-ECP.3.2. When determining whether the financial requirement in paragraph E-ECP. 3.1. is met only the following sources will be taken into account:

(a) income of the partner from specified employment or self-employment, which, in respect of a partner returning to the UK with the applicant, can include specified employment or self-employment overseas and in the UK;
(b) specified pension income of the applicant and partner;
(c) any specified maternity allowance or bereavement benefit received by the partner in the UK or any specified payment relating to service in HM Forces received by the applicant or partner;
(d) other specified income of the applicant and partner; and
(e) specified savings of the applicant and partner.

note / we do not work at the moment and we do not use any government benefits.

Many thanks

Alia

£18,600 - £16000 = £2,600 shortfall

£2,600 * 2.5 = £6,500 required in addition to first £16000 savings which are disregarded

Total: £22,500 savings required

Just a friendly reminder you need printed statements on official bank paper that are stamped and certified as genuine from your bank. Check the period allowed on them, too.

(For our spouse visa they could not be dated more than 28 days from the application, for example.....AND the entire required balance has to show throughout a 6 month period. May well be different conditions for you but check, double check and check again!)

We found our bank struggled to do this as their system was entirely set up for internet banking - only demanding a chat with the manager led to it being done properly.

But what about the section E-ECP.3.2. from a to d, as it is related to the additional amount. it seems to be complicated.

Are you apply for the visa within the UK or for entry clearance from abroad??

E-ECP3.2 refers to Entry Clearance visa from outside the UK.
Section E-LTRP: Eligibility for limited leave to remain as a partner
You need to read the above section for leave to remain application within the UK.

Hi Thanks for your advice
Yes I am applying for the visa within the UK as I am a PhD student in UK having a Tier 4 visa.
