Help with EEA (EFM)

Post by Zszs » Fri Oct 05, 2018 4:01 pm

Dear everyone,

My boyfriend and I would like to ask you few questions and would love to hear your ideas.
Me (EU narional) and my boyfriend (Canadian) have known each other for 5 years, have met while travelling in Asia.
I followed him to Canada 3 years ago when we got together and since then we have been living together for 8 months in Canada ( we have few proofs of address each to prove this). In September 2016 we left Canada together to travel for 6 months, staying at my mum's place in Slovakia for 1 month. We have lots of flights tickets printed (from canda to Europe, from europe to asia, asia to uk) and Facebook profiles with photos printed to prove this. At that point we have had a Canadian joint account that we're using while travelling, but we don't have paper statements, only print outs and we cannot stamp those statements as the account is Canadian.
Then, we arrived to the UK in end of February 2017, living at my friends flat for 2 months while we're looking for accomodation and my boyfriend was sorting out his Working holiday visa. He's got plenty of proof of address from this accomodation as he was new to the UK and was trying to sort out bank account and NINO, but I have been living in the UK before so I had my all posts directed to the other friend's address. Then after 2 months we found a house and moved in (May 2017) and since then we have strong evidence of living together.
My boyfriend's working holiday visa expire in March 2019 and he'd like to apply for EEA (EFM) where we need to proof we've been living together for two years. My question is, would those first 6 months (travelling and living at friends house for two months with me having no proof of this) affect our evidence of you think?
We could also wait with our application until February 2019 to get more evidence but will the application be still processed after Brexit in March 2019?
Thank you so much for your ideas.

Apparently, the two years of living together has to be in The United Kingdom I think.

The two years of living together doesn't necessarily has to be in United Kingdom, rather it could be anywhere in the world but a genuine prove that both of you guys have known each other for minimum of two years, living together in the same address anywhere in the word.

I applied for mine, using my country home address and documents, i didn't add any documents from United Kingdom and it was approved. Good luck.

In my non-professional and informal opinion, the best thing would be to wait to complete the full 2 years, and apply in February 2019; then stick to the terms of his visa when it expires in March 2019. Note that applying for the EFM RC will not cover the gap between his current visa expiring and the residence card being issued, so this might or might not mean he needs to leave the UK (not necessarily going back to Canada) so that he does not become an overstayer. You can always request for your passports back while the application for residence card is being considered, so he can travel.

While abroad he can always apply for a Family Permit, which is free and usually very fast, to gain entry to the UK while his application is being considered (but note you will need to supply similar evidence of 2-year cohabitation for this application as well, evidence you might have sent to the HO already for the RC application, so tricky if you do not have enough alternative evidence). Or I think he could even gain entry as a visitor on the strength of his Canadian passport (I'm sure there are a number of posts about this).
My question is, would those first 6 months (travelling and living at friends house for two months with me having no proof of this) affect our evidence of you think?
Yes. You need to prove you both lived at the same address for the full two years; if you lack proof for one of you for 6 months, yes, that is going to affect your case.
We could also wait with our application until February 2019 to get more evidence but will the application be still processed after Brexit in March 2019?
Not sure what the exact cutoff date is (so far the vague date is March 2019, but no specific day has been communicated), but as long as you apply before that day (and I think the postal stamp accounts for the accepted date), then the application will still be processed.

However, If you apply after that date, then you will need to apply for a Pre-settled status instead. Note that you can apply for yourself and include your partner in your application. Information here: https://www.gov.uk/settled-status-eu-ci ... ligibility
