Want to marry my soon to be deported asylum Seeker girlfriend - advice needed!

Post by happypies » Tue Oct 09, 2018 12:26 pm

Hi
Firstly I've found this forum and website really useful so far, so thanks already!
I know you like this as lists so here goes:

Me:
-British (from birth inc patents etc etc)
-35 years old
-Income £27,000 to £34,000/year salary, full time, permanent in civil service
-Still legally married to my ex, divorce proceedings ongoing and should be complete within a few months. divorce on the grounds of being separated for more than 2 years.
-I have one child at primary school age

Her (my girlfriend):
-Central american country, renowned for violence, murder kidnap etc.
-36 years old
-Left a good job in home country when she fled to the UK, no more saving (all spent traveling to europe)
-Initially got a 6 month visitor visa. this expired then applied for asylum.
-Asylum application was based on attempted extortion against her including death threats.
-Asylum case rejected, went to appeal and appeal was rejected 2 weeks ago, with no option for further appeal.
-Date set for deportation very soon.

Us:
-Met over internet dating
-i messaged first
-Started Watsapp messages and calls for a few days
-Met in person 6 months ago
-We have been a couple for 6 months, she regularly stays with me 4-5 days out of the week (would have been fully but she was worried about losing benefits etc.)

From what I understand I don't have much of the evidence required. Pretty much i've got Watsapp messages, photos, could get statements from a church minister and family, amazon shopping order history (addressed to her and her address), me paying for her phone top ups.

What are our options given she is being deported and is not allowed to return to the UK (i forget for how long)?
-I can travel to her home country in a few months or nearby and we get married, then apply for married/spouse visa?
-Same but apply for fiance visa and get married in the UK

-Will she be allowed to do any of these given her refused asylum and deportation?

its been a difficult few weeks
Thanks.

No, we wont have time before deportation.
It will have to be overseas, either in her home country or somewhere she can travel to.

Other option is the fiancee visa route to get her back to UK then we will marry here.
Really i don't have a preference as long as she can come back to me.

What benefits is your girlfriend worried about losing? This may have an affect on a settlement visa application.
(Casa, not CR001)

Hi. Good question.

Nothing special. She was given accommodation including bills etc, in a shared house, and £35
per week for living expenses.
She also had access to NHS and used it a few times.

thanks
