Hi Gurus,

I would like to know if a switch to tier2 is at all possible, after the tier1 ent extension refusal?

I can think of two scenarios:

1) Extension refusal received --> got 14 days to apply for AR --> AR applied and refused --> Switch to tier 2. Is it possible?

2) Point 1 (until AR refused) --> Apply for fresh Tier 1 extension --> Vary the application to Tier 2. Is it possible?

Can the refusal reason (for Tier 1 extension) impact the switch to tier 2 ? Any other thoughts are also welcomed.

I am aware that switch to tier2 is possible while tier1 extension application is in progress.
Thanks for asking relevant question. I have applied last year Apr for tier 1 extension and have faced a office visit this year January. Now still waiting. I am confused too. I was pretty sure from this tier 1 application I can not switch to tier 2. But now from you I am confused again.

Question 1. Are you sure we can vary to tier 2 application?

Question 2. If we vary to tier 2 during application process and by the time tier 2 reault come, if I spend 5 years (which will be Apr 2019) in the ground I am now, will I able to make ILR application (though I vary to tier 2).

Question 3. If I get refusal before 5 years in this ground then what would be best way to approach to continue for 10years long residency which is due on 4th Feb 2020.

I am new in this forum so please guide me all gurus.

Thanks

UK tier 1 (entrepreneur) Extension applied, now what is good approach after refusal

Post by Jamukoi007 » Tue Oct 09, 2018 9:37 pm

Dear Gurus

New in forum. Please help me. I am confused.

I have got tier 1 entrepreneur on 25th Apr 2014 and applied for extension on 22nd of Apr 2017. Still waiting for the result. They visited my office on Jan this year. However my 10 years of residency in due on 4th Feb 2020 and my 5 years on this tier 1 entrepreneur ground due on 24th Apr 2019.

Question:

1. If I get refusal before 5 years in this ground then what would be best way to approach to continue for 10years long residency which is due on 4th Feb 2020.

2. Is there any other way I can vary application and keep 3c till my 10 years complete and then apply for ILR.

1. Yes
2. Yes, if you qualify under T1E rules
3. Depends on whether you have any grounds to apply for another visa
