I am a dual citizen of the UK and Sri Lanka, permanently living in Sri Lanka for the past 4 years. I got married to my Sri Lankan husband a year ago and we were hoping to make a trip to the UK this month to celebrate our anniversary and visit my sister, also a British citizen, living and working in the UK. I also own a property in the UK for which affairs need taking care of that I was hoping to do on this trip, a point which we included in my husbands initial application.
Unfortunately my husbands visa was refused, we would like to reapply as soon as possible with clarification and additional evidence on the points made by the ECO, but I am unsure about a couple of things. I have attached the visa refusal document below.
My questions are:
Regarding point one: were we wrong to apply for a family visit visa since we only intend on visiting for 28 days, and should we in the subsequent application apply for a standard visitor visa?
My husband is currently unemployed and his main source of income is through investments and savings. We were under the impression that simply showing the funds available in his account would be sufficient. We were unaware that that we would have to prove ownership of the funds or their origin since he uses the account daily for all our expenses. We of course have evidence of the origin of the funds and the proof of his investments which we will provide when we re-apply. Would this be sufficient for the ECO or is there damage done by not including this information in the original application?
Should we mention and produce documents of my property in the UK again when we reapply? I am unsure as to whether it was relevant to his application.
My sister provided a letter of invitation since we plan on staying with her for the duration of our trip should we send this letter again?
We plan on writing a letter addressing the ECO's points for refusal, we realise that there should be compelling reasons for my husband to return to Sri Lanka but because of his employment status we are unsure of what further information we can provide. We had already included his car documents and documentation of property he owns. Is it worth mentioning that we live a very comfortable life here and have no interest in settling in the UK at this moment? I am also in the process of qualifying as an attorney in Sri Lanka and have no intention of violating immigration rules.
