Tier2(general) to ILR

Post by kannie » Thu Oct 11, 2018 8:26 pm

Hi,

My husband is currently on tier2(general) visa and will be eligible for ILR in January 2019. I and my elder daughter will be eligible (as PBS dependents) in April 2019. I have the following questions regarding ILR:

1. My husband is planning to apply for ILR in January 2019. Will that affects the visa status for me and my elder daughter(as PBS dependent)?
2. Do me and my daughter need to get another visa when he gets his ILR? Or can we apply in April 2019 for ILR as we will be eligible by that time?
3. My younger daughter is UK born and PBS dependent as well. What will be the status of her visa after my husband's ILR?

Sorry for so many questions but we are about to start our process now. Please help.

No effect on your visa if he applies for ILR based on Tier 2 General and 5 years residence.
2. Do me and my daughter need to get another visa when he gets his ILR? Or can we apply in April 2019 for ILR as we will be eligible by that time?
No you don't. You can apply for ILR when you qualify, counted from date of your first PBS Dependent visa, as long as you apply while you still have a valid visa.
3. My younger daughter is UK born and PBS dependent as well. What will be the status of her visa after my husband's ILR?
You can apply to register her as British on form MN1 under section 1(3) of the nationality act. She does NOT require ILR for this.

Thanks a lot for your quick response.

Just wanted to be clear on point 2.

Our PBS dependent visa was granted on 7th January 2014 but we landed in UK on 20th April 2014. While applying for ILR which month I am supposed to consider January or April?

PBS Dependent counts from visa start date.

In my opinion, I would wait till closer to my entry date and apply in March before the fee increases, simply to avoid any risk of refusal for applying too early, but that is just me as I am risk averse.
