Cohabitation documents for ILR using Set(O)

Post by Paul01010 » Sun Aug 05, 2018 1:28 pm

Dear Experts

Need your advice.

I am applying for ILR dependant for my wife (I have received my British passport - Former Tier 1 PBS visa)

In order to prove the Cohabitation requirement, I have below documents -

1. Council Bill for the last 5 years
2. Joint Bank account (can produce bank statements for the last two years)

Question -

1. Are the above documents enough to prove Cohabitation?
2. Do I really need to submit 2 years bank statement or last 6 months statement enough? If I need it for 2 years, can I submit the online statement copies(with bank logo and other details)?

Many thanks.
Paul

Dear Experts

Need your help please.

I am preparing for my wife's application for ILR(Set O).
She has completed 4 years, 7months and 26days in the UK from the date of entry into the UK till date.

Is she eligible for ILR application?

Thanks in advance.

Just to give some clarity-

Her visa was approved on 11/11/2013 and she entered into the UK on 13/12/2013.

She is not eligible yet. She will be eligible 28 days before completing the five years, mid Oct 2018

ILR dependant - SET 0 clarification

Post by Paul01010 » Thu Oct 18, 2018 12:31 am

Dear Experts

I wanted to gain clarity on the exact meaning of ILR appication(SET O) question
Question 6.14 - 'Does the period of stay on which this application was based include any leave granted since 11 January 2018?'

The guidance document says below -

You must not include any absence from the UK during periods of leave granted under the Rules in place before 11 January 2018 towards the 180 days allowable
absences. For example, if a dependant’s qualifying period includes initial leave granted from 1 January 2015 to 31 December 2017, and an extension granted from
1 January 2018 to 31 December 2019, you must not count any absences before 1 January 2018.

My wife came to the UK with Tier 1 Dependant visa Dec 2013 and subsequently applied for an extension on Aug 2015 and Aug 2018.

She wants to apply for her ILR in Nov 2018. She was away for below number of days.

No of Days
Year 1 - 20
Year 2 - 72
Year 3 - 32
Year 4 - 64
Year 5 - 4

From 11th Jan 2018 till 29th Nov 2018, she has 20 days of absence.
Is she qualifying for ILR and should I only mention about the 20 days as part of this question only?
