Spouse visa with non-resident UK citizen

Good afternoon all,

I am a UK citizen working overseas with a charity, and am currently non-resident in the UK for tax purposes. My wife is a US citizen, and currently lives there. I plan to leave my overseas job and move to the UK in the new year, and for my wife to join me there on a spouse visa.

My current role meets the financial requirements, and I have a property in the UK ready to move back into. To start the spouse visa process, do I already need to be in the UK with a new job, or can we start the application while I am still non-resident?

Unless you meet the financial requirements with savings of £62,500, you will need to submit evidence of your earnings equivalent to at least £18,600 in your current country of residence for the 12 months period prior to submitting your wife's application AND have a confirmed job offer to start in the UK within 3 months of arrival, again meeting the £18.600 p.a income level.

Alternatively, you could return to the UK ahead of your wife and apply for her spouse visa once you can submit 6 months of payslips + the corresponding bank statements, showing that you are earning annually £18.600 pro rata
