Contract Salary different than CoS Salary

Hi all,

Salary on my CoS is 55K. My employer contract is on 40K.

I am scared that this will cause issues with my Tier 2 extension or ILR later on?

Please advise,

You should be getting paid what the CoS states and what your visa was approved for.

I completely agree but HR and Immigration firm put that 55K on my CoS!

Can I request from HR to change my Salary CoS via sms portal? Notify the Home Office. Not sure if that is possible or will cause issues with Home Office.

What salary was in the Rlmt?

Did they put £55k just to get RCoS approval?

They risk losing their sponsor licence. HO takes a dim view of this.

Sorry for the late reply as I was travelling. Just landed in London.

The salary in the RLMT is 55K.

I am receiving 40K salary but this is not to trick Home Office as the minimum was 21K.

The reason I am receiving 40K is because my employer provides me with accommodation for 15K a year (55-40 difference). So they deduct that from my salary (55K), and thus I receive 40K.

But I am not sure if HMRC likes that or if it is legal..

Would much appreciate your advise as I spoke to my employer about it but they said it is alright (even though I don't much agree and agree with you).

It's legal and you are not being underpaid then. Your package is 55k as per Rlmt.
