Spouse Visa Renewal, financial requirement, 10 year route?

My wife's spouse visa's up for renewal in Spring 2020 (want to get advice early, please).

There's a significant chance that we will not be able to meet the financial requirements (wife's English should be good enough to pass the English test, but not to actually get hired; my earning potential isn't very good).

We have one baby (the baby's a UK citizen, because I the father am a UK citizen and the baby was born in the UK recently).

1) Will the visa people automatically put my wife on the 10 year route because of the baby, or is there a chance that they'll deport my wife?

2) Is there a separate form for the 10-year route?

(Hopefully we'll have our finances sorted before the application, but asking just in case.)

They will not automatically deport your wifge if you have a refusal, as you will have the right to appeal.

The 10 year route is discretionary which means if you do not meet certain aspects such as financial requirement then you can put you on it. You cannot select to be put on it, or fill up a specific form for it.

Your baby is British so wont need to be included in financial calculation.

You can combine both peoples job or include any savings over £16000 to meet the shortfall.

You can also be exempt if you receive certain benefits such as carers Allowance.

Alot of things can change between now and 2020 for you, so you may even have a job by then, and also may meet the requirement.

You won't automatically be granted leave under the 10 year route. Hopefully the situation will improve for you before 2020, but if you are still unable to meet the minimum income level, your wife should submit a FLR(FP) Partner route application, which is also a 10 year route to settlement.

However, if your wife is granted FLR(FP), once you have sufficient income you should be able to switch to FLR(M).
