ILR Can I travel to own country ?

Post by zet1377 » Tue Oct 30, 2018 11:09 pm

Hi everyone !!!!
I have recently received ILR few months ago ! After 6 years of Discretionary Leave and I have been granted for a reason not covered by the Immigration Rules!.I believe once you obtain ILR you can apply for your "home" country passport and then there are no travel restrictions ?? Cos my immigration lawyer advice me “ILR has no restriction” and I can apply for my own country passport and can travel to my own country. My embassy provided me with emergency travel document because my passport expired 14 years ago !!! and I have to travel to my country and obtain passport there only !!!
I want to visit my country for a week but not sure whether I will be allowed to come back.
I will be grateful if u can post any information regarding this matter.Would it be problem for my naturalisation ? Or will I have any trouble at airport coming back ???

In theory yes you can travel back however you could face questioning by UKVI and risk even losing your ILR.
This could also affect you if you plan to get British citizenship in the future.

Thank you for getting back to me.
I've received settlement visa too. But my solicitor keep asking why I don't apply for my national passport ever since I got my Discretionary Leave !!?? I spoke to him yesterday and he keep saying that I've got different kind of visa !!! Based on Non-Immigration rules -Private and Family Life and HO don't even look at my failed asylum application which was refused back to 2005 !!!
He keep saying that I got private life too and I can't sit here for 18 years without travelling abroad ??? Forget about my country but maybe I wanna travel to Spain for example with my girlfriend and kids ??? How can I travel without my passport ????
But to apply for my national passport I must travel there !!! I've been issued with Emergency Travel Document and I can't say to HO that my Embassy refusing to give me my passport !!!
Don't know what to do!!!!!! ;((((

Any thoughts about this???

The question here is why you were granted 'discretionary leave to remain' in the first place ??
What made you eligible to be granted such leave ? What is your immigration history ?
If you claimed you could not go back, then you can see why home office might claim that your claims were false and you secured visa and subsequently ILR via deception. The rules then allow HO to revoke your ILR

2000 -applied for asylum
2005 -asylum refused
Not right to appeal
Then in 2011 under “legacy” program was granted
Descretionaly leave for 3 years ( non- Immigration rules)
2014 - further 3 years
2017 - granted ILR ! ( Private and Family Life , my girlfriend is British and with two kids , they are not mine)
All this time I was in England and never applied for my national passport! Now I got ILR I’ve decided to contact my Embassy to obtain passport. I gave them my old which was expired 14 years ago !!! And been told that because passport expired long time ago I must travel to my country and obtain it there ! They provided me Emergency Travel Document which is valid for a month only ! I got plane tickets too but now scare to travel cos I read that HO can revoke my ILR ! I can’t apply for British Citizenship under new 10 years rule , only allowe in 2021 !!! :(((( People.... they should understand that we are human beings I wanna life as well ??!! I can sit here like in prison 22 years without travelling somewhere!!!! But if I want to travel I need my passport!!! Can anyone answer me please... Can I travel to my home country??? Thanks!!!
