Tier 1E Job Creation for ILR

Post by bizman » Fri Nov 02, 2018 12:51 pm

Hello Gurus and senior members

I have a my ILR submission coming up next year December, actually due to submit within 28 days before 11th of December 2019. I employed two employees in July this year, one is still on the other left end of September spending three months with me. I have employed another one this November and he is earning almost half of what the employee that left earned. They are both in the same role in the company as Project manager. The previous employee earned £2500/month and current one earns minimum wage as he doesn’t have same experience as the employee that left, this translates to £1018 for 130 hrs a month.
My questions
1, I hope disparity in salaries of the employees in same role doesn’t matter. They both met the required number of hours required and they are above minimum wage.
2, I also hope that the fact that there is a month break in the same role, one employee occupied for three months and the other I am hoping will occupy for another minimum 10 months does not matter in the same role.

The other employee seem stable and happy with his role and I think will stay for a long time from all indication.

Your responses will be highly appreciated.

Thanks

You should be fine.
The requirement does not specify a salary at all.
Also a post does not need to be continuous, it simply needs to have existed 12 months in total

ok. So, as @zimba said, the immigration rules do not specify a salary at all.

However, the rules do specify that the same job has to continue for 12 months. When you have such a substantial change in salary, be prepared to answer why the same job can have such different salary. Make sure they have the same job title and you correctly fill the job table (both employees in the same job table). It is perfectly justifiable that you learnt from experience that the same job could be done by a less experienced person and so hired someone much junior.

I haven't come across a case where there has been such an issue yet, but the post 2014 cases are still quite recent.

One more question, is it necessary to include financial account in ILR having submitted it for investment during extension. And also statement of bank account. Is it necessary.

Thanks.

No need for company accounts.

Bank statement - yes, as part of the evidence to show you are still involved in an UK business
