ILR LR Qualifying period

I am asking this question behalf of my frnd's.

My Frnd immigration history is below:

1.Visa stamping date 30/09/2008.
2. Arrival in the UK 29/01/2009


Can he apply ILR LR before 28 days Visa stamp Or date of arrival in the UK ?

It would be great if someone helps clarify this.
