Extended family member of EEA national spouse.

Hello everyone,

Please can anyone shed some light on the current extended family member RC rules.

We have recently applied for a RC for my husband's mum on a basis that she is dependent direct family member of a EEA citizen (myself, I'm Polish) at the same time we applied for RC for her son who is 15 years old and also fully dependent on us (myself, my husband and his mum). We have received certificate of application for the child stating that he is extended family member of a EEA citizen and they are unable to confirm his right to work as he has no automatic right to reside.

In a light of a recent changes that the rights of extended family members only applies to
relatives of the EEA national and not to relatives of the EEA national’s spouse or civil
partner is there any ground under which he can still be issued with RC card.

He is a member of our household and fully dependent on us. His mum's RC case is straight forward and we've provided lots statements showing financial dependency for period of over 3 years, however I am worried that he can be refused. Can a child be refused RC if his mum is issued with one and they are both dependent and living with us?
