Your post is confusing. Is your partner living with you in India or with his wife in the UK ?

You won't qualify for an Unmarried Partner visa while he is still married to another woman.

Did your partner acquire his British citizenship before or after the birth of your child? Is he named on the birth certificate?

My understanding is that the partner lives in the UK and has a wife. But more information needs to be given by the OP.

Sorry about any confusion caused.

I work in india and live with my kid .My partner comes twice in a year.He comes during his vacation. He lives in UK with his wife[ she is included in his passport as well].Before my kid i was with him in UK as i went thru my companys' work visa..I usually go on my office trip for short term to UK before my kid.
He got his British passport after my kid was born. His name is included in my kids Birth Certificate too.

My query is - Will i be able to travel with my kid to UK if my company provides a work permit.I doubt my kid visa will be rejected as my partner's passport has his wife name included. Please help on the same.
Thank you.

Then you are not an unmarried spouse/partner. For that designation, you need to have lived together for at least two years with joint financial responsibilities (joint bank accounts, joint mortgages, etc).

British passports do not have the spouse's name listed in them. He may have listed his wife as Emergency Contact, but that is about it and that does not denote a relationship.

There should be no problems with that as that has noting to do with your relationship. You are being sponsored by your company and presumably so will your child. That is a matter between you and your company's HR.

Thank you so much for the responses.

I get the point about the British Passport that it doesnt include the wifes' name. However when i apply for my kid visa i should be submitting both my partners' and my passpost details along with my kid's birth certificate [if i am not wrong]. On the basic verification on the parents passport check it will be notified that i am not his legal partner.

My worry is "are there any possibities that my kid visa get rejected on this ground.Really confused.Need clarity on this please."

It's a delicate situation.

Purely in terms of "Routes", you can't use your partner as he is married.

You are looking for a Tier 2 from your employer here.

You can bring your son as a dependent, but you can't hide from them who is his father. So they will quickly see the entire situation. The fact that you are in extra-marital affair with a British, having a kid with him and having to the project to go to the UK can be perceived as a pure immigration move to settle in the UK. I am just speculating but from reading many letters from HO, I am trying to go forward and try to think how they will perceive the situation.

Yes exactly.
Earlier when i used to travel i never produced the marraige certificates[ as it is also one of the required documents as per HR policy -India in few organisations].But now with my kid i am really worried as to how to go about submitting my kid's visa.Helpless.Not sure of how i get this resolved.

Laxmi.
