ILR Eligibility Query

Post by scher » Sat Apr 23, 2022 10:46 pm

Hi Guys,
Good evening, My wife's visa statuses are as mentioned below
1.She came to uk on Tier 2 general dependent visa on 2014 Oct
2.She is on Tier 2 dependent visa until Oct 2019 and then I have applied for her FLR(M) Visa as I got my ILR on Sep 2019 based on Ten years route as my salary was under 35k salary.
3. Her FLR(M) visa was granted from Nov 2019 till June 2022.

Now I would like to know that is she is now eligible for ILR visa as she has stayed in UK on my Tier 2 dependent visa for 5 years ie from Oct 2014 to Oct 2019. My salary during that period was under 35k. Hence I have applied for my ILR based on 10 years route. I got my ILR VISA on Sep 2019.

Please clarify my doubts as above..If she is eligible for ILR then I will apply for ILR visa otherwise I will apply for FLR(M) extension..
Thanks and Regards,
scher.

No, she needs 5 years in FLR M before she can apply for ilr based on 5 years residence

You cannot combine PBS dependent time with for M to make up 5 years and she cannot apply for ilr based on PBS dependent visa either as you got ilr through set LR and she is no longer a PBS dependent visa holder anyway.
