SET M 5 years to ILR question

SET M 5 years to ILR question

Hello, guys .
Am looking for an advise please, if someone is kind enough to help it will be appreciated.
I was on 10yrs partner route. First 30months BRP expired 01-03-2018.

I had to switch to 5yrs as I wasn't with my kids mother anymore and I have high income aswell.
First 5yrs BRP was granted 02-03-2018 and it expired 02-09-2020
Second BRP application for renewal was submitted, 15-08-2020. But due to COVID-19 I couldn't do super priority service so the application took 6months waiting period.... Application was granted on 08-02-2021 which is now due to expired in August. I have some gaps due to covid while waiting.. So my question is this do I need to wait 28days for current card expires, in order to apply for ILR? or can i apply counting 60months from my first BRP 02-03-2018 which when my first card was issued? Thanks in advance.

Seems by my calculations, you're due for ILR now. You can make your application at anytime, provided you have all other required documents.
No sin in failing, you just have to try and try again!

I suppose I could try but its a big amount of money as my intention is super priority but I don't wanna take the risk of been refused as they won't refund.
I want to be sure if the gap won't be a problem for a refusal. Thanks

I want to be sure if the gap won't be a problem for a refusal. So far you made an in time application, the period of waiting for decision on the application is legal and therefore no gap at all in your immigrationhistory.. Thanks
