Work requirement for Ancestry visa

Post by lainybug » Sun Mar 26, 2023 3:37 pm

Hi All,

Just a quick question please...

A family member is in the UK on an Ancestry visa. Working, or looking for work, is obviously a requirement of this visa, but the guidance says this can be part-time or voluntary. As such, would caring for another family member's child be considered as employment? Would this need to be paid, similar to an au pair agreement?

In this case, all the visa holder's bills are being covered by family.

Thanks

Ancestry visa is a work visa. When they get to ILR stage, they have to provide evidence that they have worked, payslips, bank statements or if voluntary work, an official employment letter etc.

You must also prove you:

have enough money to support yourself and your dependants
can, and plan to, work in the UK
are still a Commonwealth citizen

Thanks. We have read all the guidance in detail. However, it is not clear whether being paid to care for a grandchild counts as employment. I.e. if filling in Set form O, would this be classed as "working in the UK" or as "a relative regularly giving you money"? Thanks

If they are being paid, then they have to be paying tax and NI and getting payslips. The employer will have to register as as appropriate.
