Eligibility Q: British Citizenship (Hong Kong) Act 1997

Post by deadflappin » Thu Mar 05, 2009 9:56 am

I hold a BN(O) passport issued in 1990 by birth, along with a HKSAR and a Taiwan passport (obtained in 2008).

I read the British Nationality (Hong Kong) Act 1997 and they had two categories, an ordinary residence requirement and nationality requirement. Under the nationality requirement, it states "you must not have held any other non-British nationality". Does this mean I will be illegible to apply under the EM category? Since I also hold a Taiwan nationality.

Also under the ordinary residence requirement it states that to be considered an ordinary residence I have to "be living in the country full-time (apart from temporary or occasional absences)". I moved to Taiwan in 2003 because my grandfather was sick from cancer. I attended middle school and graduated from a high school there, could this be considered a temporary absence? Or would this make me illegible for an application?

If I am to be considered illegible, are there any other ways to attain a British Citizenship?

One more question, I read that to apply for British Citizenship via naturalisation, I am required to live in the UK for at least 5 years. I was wondering if going to university under a student visa would account for 4 of those 5 years.

No.

Only certain work-related visas count towards the five years. Post study work visas also do not count (if in case you were wondering).
