Hiya

There are similar posts on here, but just wanted to clarify. I am a UK citizen since Birth, my husband from Iran is in the UK on a 2 year spousal visa. He secured employment about 3 months ago, while I however was having difficulty finding work. We began a joint claim for WTC. I set it up so payments are made into my sole account not our joint account (as home office informed me this could be viewed as my husband having recourse to public funds). The paperwork states that my husband works over 30 hours while I do not. However the only thing that concerns me is that it says payments are to be made to my husbands name.

Could this be viewed by home office that he is in receipt of public funds, or do they know how WTC works and know that the WTC can only be paid to the person who is working, and not to the person who is not.

I called WTC to ask if they could alter this, but they said that as I am not currently working it has to be paid to my husband.

Please help me as I am nervous I have jeopardised his case.

Are you or your husband the applicant?

If you were the one that made the application, then he will be fine

If you can provide evidence that you are the claimant and that your husband's presence didn't result in you having to claim additional benefits, you will be fine.

Working Tax Credit is not actually included on the list of forbidden public fund.

Working Tax Credit is included in Public funds. However, you are allowed to claim it, if you are eligible.

I am the main applicant on the application but as my husband is the one who is working, it is being paid in his name but into my sole bank account. Not a joint bank account. As I am not working, could it be viewed that I am not eligible to claim WTC, or am I eligible as a British citizen as my husband is working, therefore as a family unit we are entitled?
