working holiday maker visa please advise ??????????

Post by inquiry27 » Sun Jun 12, 2005 10:10 pm

hi all
am a commonwealth citizen and am on a working holidaymaker visa and i was wondering if its possible to change or revert to WP after or before my 2yr period finishes since the job that am doing is currently temporary but i will become a permanent employee in like two weeks times "will this help at all"?

also i wanted to know what the new laws are regarding marriages to EU citizens since am planning to get married with my french galfriend and people have told me that its not possible to get married n the UK if the fiance(e)
is not british citizen or national ??? and will it be possible to get married here or we have to go back to france or my home country ? and what documentation will they require if we were to get married here or if we marry overseas and come back here ?
And after our marriage how will it affect my status and how soon ?does my galfriend have to apply for residence permit for both of us to continue working and living in the UK ? and another thing ......she is currently on a nursing programme and working part time like 5 to 10 hrs a week ! will this affect our situation or case in any case?

I'll just pick up on this bit :-

It is not true. A French Citizen will encounter no particular problem getting married in the UK. The same applies to a citizen of any EEA country.

But you! You say you are a Commonwealth Citizen. I presume you are not from Cyprus or Malta, otherwise you would also be an EEA Citizen and again would have no problem.

So assuming you are from elsewhere in the Commonwealth, and therefore you are not an EEA Citizen, and also assuming there is at least three months left on your current visa, you can apply for a CoA, that is, a Certificate of Approval for Marriage. You can download the application form by clicking here.

Once you have your CoA, you and your fiancée can go along to a designated Register Office and give the necessary Notice of Intention to Marry, then get married, after which you can apply for an EEA Family Permit. You fiancée is already exercising her treaty rights to live and work in the UK ... you will effectively have the same rights as her.
