Comments needed from experts and people who have already done a similar thing as explained below.

I am planning to extend my HSMP visa (that expires on 20 NOV 2009) along with my wife. I am meeting all the eligibility criteria to get an extension, however the maintenance fund criteria form my wife is falling short (by 18 days) of required 3 months.

With this situation I will not be applying for the extension togather.
I will go for my HSMP/Tier1 extension and get it done before 20 NOV 2009. Then I will use the same set of funds (which I would have shown for my eligibility) to show the maintenance criteria for the dependent visa application. By doing this, clearly I am not go against any rules in the depedence guidance (http://www.ukba.homeoffice.gov.uk/sitec ... policy.pdf)

Just wanted to know whether anybody has gone through such a situation earlier and have applied in a similar way. Please share your experience. Also experts, please share your thoughts and guidance.

In the same link provided by you please read Paragraph 41 and 42 on Page 8:

41.If the same Tier 1 migrant and his family had been present in the UK for two years, they would require evidence that they held £2399 (£533 x 3 = £1599 + £800) in available funds.
42. If a dependant applies separately from the Tier 1 migrant, there must still be enough funds to support each member of the family. Therefore in the example above, if the family has a third child, the main applicant has been in the United Kingdom for two years and the family applies for leave to remain for the third child separately, they must provide evidence that they have an additional £533 in available funds.


so even if u apply for ur spouse after u get ur visa with in the specified peirod.. even than there must still be enough funds to support each memeber of the family that means both of u..

you can use this separate application to cover those 18days period if possible...???
