Spouse Visa Confusion

Hi,
I have a bit of confusion when to apply ILR for my spouse as the documentation on the form is not clear. Was wondering if anybody here can help.

My husband came to UK in Jan 2008 as a dependant on HSMP. I later got an ILR in July 2008. Since, he hadn't completed 2 years in the country, therefore, he couldn't apply for ILR and got a spouse visa based on my ILR.

Now the question is whether he is entitled for an ILR in jan 2010, since he would have completed two years in the country or will it be july 2010.

Does a person needs to be in country for 2 years or in country for 2 years on spouse visa to get an ILR.

I would say it should be 2 years as your dependent. Wait for others to reply.
