hi,
my friend UK citizen girl asking what is the requirements/documents needed< her fiancée (non UK citizen) will fly to UK for marrying her and then return back to his country, he is not intend to migrate/live in UK. just wants to know the documents and procedure.

A visa to visit is *not* the same as a visa to visit and marry.

If they want to visit and marry - they require a visitor visa for marriage. Otherwise they will have to apply for a Certificate of Approval (the scheme for which is going to be abolished at somepoint soon - but we don't know if anything will replace it).

(Search for COA for more information).

The imam who will perform the ceremony will be able to help you with the right procedures to marry beyond the visa.

I want to add one more thing ...

Having a UK based fiancee and applying for a visit visa for marriage is going to provoke a good amount of checking. They are going to be looking for *very* good reasons why the newly married person is going to return to their home country.

They will need to show that there are very strong ties, that he's got work to return to, and if it is appropriate, details of how his now wife will go with him.

The ECO is going to be concerned that the person is taking the 'cheap' route to come to the UK (since a visitor visa is ~£70 compared to the ~£500 for the fiancee settlement visa).

lailaaa3, when do the two of them plan to marry?

I ask because it will be a lot less hassle to do this after CoAs are abolished, late 2010 or early 2011, because it is reasonable to assume that the marriage visitor visa will also be abolished at the same time.

And the nationality of the fiancé? Does he need a visa to visit the UK?

he is kenyan nationality , he dont want to live in UK or migrate to UK, he got very good paid job and he is professional,

yeah, she will live in kenya with him, also she will get kenya citizenship. again, the husband very well paid and financially is ok as he is very professional person. please note that the UK girl originally from kenya.

OK, have a look at this webpage which is from Birmingham Register Office. Other Register Offices will tend to have a similar webpage.

In particular I emphasise :-
You must each have lived in the district of residence in England or Wales for seven clear days before either notice is given. It does not matter if you move to a different address after notice has been entered.
-: so the thing to do first is .... wait! Let's say, to illustrate, he arrives in the UK on Sunday 5th December, and thus moves into a UK address, then wait 7 clear days .... Monday 6th to Sunday 12th ... means that Monday 13th would be the first day that notice can be given at the Register Office.

what the register office needs as documents? is in clearance entry visa stamped in passport will not be enough to pull the records?

yes she read the requirements, one of the document needed is divorce certificate which he mentioned in visit visa for marriage that he is separated already as he did not have certificate of divorce yet. Question, will register office will retrieve the visit visa for marriage records and asked for the divorce certificate ?

He cannot give the needed "Notice of Intention to Marry" until he is divorced. To do so would amount to perjury, a very serious criminal offence.

When is the divorce likely to happen? How long from now?

There is a danger of confusing a "mere" religious marriage, and a legal marriage. UK law says that the person is not entitled to enter into a legal marriage in the UK, unless they are not already legally married to anyone else.

So whilst the UK does not prohibit a person entering into any number of religious marriages, as permitted by their religion, but as regards a legal marriage there are specific requirements.

I think John was right if this policy reviewis anything to go by. The British state recognised polygamy (for benefit purpose)as long as it took place in another country where the arrangement is legal.

Note this ''In addition, officials have identified a potential loophole by which a man can divorce his wife under British law while continuing to live with her as his spouse under Islamic law, and obtain a spouse visa for a foreign woman who he can legally marry''.

"Entry clearance may not be withheld from a second wife where the husband has divorced his previous wife and the divorce is thought to be one of convenience," an immigration rulebook advises. "This is so, even if the husband is still living with the previous wife and to issue the entry clearance would lead to the formation of a polygamous household."
