Hi,

I have come to UK as a student in 2003, then got HSMP approval in Nov 2006. Using HSMP approval letter I got first HSMP stamp in March 2007. Then renew for 3 years in 2009. Now I have to apply ILR this month.

Which date should I use for the question,

6.1 When did you (the main applicant) first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.

Is it,
1. The date I enter as a student?(Aug 2003)) or
2. The date of HSMP first stamp? (March 2007)

Note : I didn't enter to UK using HSMP stamp as I was in the UK while the first HSMP stamp.

Hi Vinaya,

I have called two occasions to HO this afternoon before get a reply in the forum, in both occasions they have confirmed that I need to use HSMP first stamp date.

What do you think of this as I am confused?

to be Honest I would not be too worried about this. The question clearly states ' When did you FIRST arrive in the UK'...so I would use the date you first came to UK.

I was in a similar position and the date i included was, when i entered on a student visa.

Many thanks for your reply Vinaya. So I have to write all absences since came as a student. Does it count 180 days rule while absence as a student visa?

Yes you have to include all absences since you first arrived.

As far as rules regarding the absences are concerned, it is only the 5 year period you have spent on Tier 1 comes in to perpsective.

Hi,
I got ILR this year, i came to UK on student visa and later moved to sponsored work permit.

6.1, I entered my student visa date

Regarding the absences, i entered during work permit duration.

the question doesn't ask your first entry date but the date based on which the ILR application is based. You are not claiming the student visa period for ILR - so in this case it will be date of HSMP stamp i.e. march 2007

Thanks Ban.s. This is what exactly HO told when I called them. I specifically told them that I didn't enter to country with HSMP visa and I have explained them that I was in the country while got first HSMP stamp. So still they confirmed that I need to enter HSMP start date and not the student visa entry date.

To be safe, I will get two copies of the page where this question is and fill information based on both entry dates. So I have all ready at the PEO appointment and can provide as they need.

Hi,

I have another query regards to filling the absences in the SET(O) form and thought to continue the question in my previous topic rather open a new one.

In the list of absences, it asks the 'REASON FOR ABSENCE'. I was away for my home coutry twice for a holiday. Both occations it has been paid as it was covered from my annual leave. In this case what is the best answer for the 'Reason for Absence', is it 'Holiday' or Annual Leave or any other suggesions please? Also I got a letter from my employer confirming it was paid during my holiday on both occations and in the letter it says the reason is annual leave.

Don't think it matters too much as long as your absence is inline with your leave allowance.
you can write any generic reason like visiting family, personal holiday etc.

Hi, I am currently filling up the set(O) of the visa application form for ILR, the question 6.1 as above is a bit confusing. When my tier 1 general visa was issued in August 2009, I also had my work permit valid I.e. An overlap between the visas. Now to fill this form should I be answering the date I entered using my work permit I.e 2007 or 2009 the tier 1 entry into uk date?
