Tier 1 Extension query

Post by DesiBoys » Sun Mar 04, 2012 1:49 pm

Hi All,

I am currently on a spouse dependent tier 1 visa. Our visas are expiring in August but we plan to send the application for extension this month.

My husband would be sending his visa (main) application this week. I need my passport for some official purposes and cannot send it along with the main application.

Can I then send my dependent application after 2-3 weeks or do I need to wait until my husband (main applicant) successfully get his new extended visa application back (which will be 6-8 weeks from submission)?

Thanks

You can send before your husbands application is decided but will have to pay normal charge for extension. discounted charge applicable when dependents apply with main applicant will not be applicable to you.

in the covering letter mention that main applicants extension application is pending with UKBA

I would suggest though to wait until his application is decided. validity will be the same as main applicant no matter when dependent applies

Thanks for your reply.

May I ask the reason for you suggesting to wait for main applicant's outcome? As the fee is increasing from April, i was hoping to send my dependent application this month itself perhaps a week or later after my partners'.

Well you need to consult with a senior member on this.

My take on this is that if you apply separately, the main applicant should have got the extension.

I am not sure how UKBA is going to solve the riddle of matching the main applicant and dependant applicants together if you send it separately and then consider both for extension.

It would be better if you can apply together with your husband at the end of March. That would give you 2-3 weeks and you wouldn't have to pay additional fee. Your husband would just have to delay his application.

What I don't understand is, you are extending earlier and would have to extend again (with increased fee) before you apply for ILR. That would make the total figure: £1500 + £2250 and then ILR fee. Would it not be easier if you apply in August and just pay up £2250 (if your husband did not arrive late by more than 3 months to UK after getting the initial Visa)
