Entry to UK with few days of tier1 visa validity

Post by varghesejim » Wed Apr 04, 2012 1:11 pm

One of my friend is working here for almost five years on tier1 and will be eligible for ILR shortly. He wants to travel to his home country(before he is eligible for ILR) and come back before applying to ILR. When he come back he will only have a few days of his tier1 visa left. Extending before travelling costs big money.

Scenario:
tier1 visa valid until June 28th
Eligibile for ILR from June 1st.
Need to to travel on May 20th.
Coming back on June 15th.
planning to apply for ILR on June 20th

Question:
If he travel and come back before a few days of his visa expiry, will he have a problem in immigration?

What I meant to say is he have an option to extend his tier1 before he go to be on the safer side. But he is eligible for ILR on a later date but not before travelling

Don't want to cause panic, but who you spoke to are call centre based staff. They must have said "THIS SHOULD BE FINE" and you are interpreting that as "YOU WILL BE FINE"

Immigrant do not have problems if their visits and reasons for visits are genuine

I don't see a problem with this. I travelled out/in of/to UK with 1 week to spare on visa expiry.
