PBS - Correct band selection for 9 months salary. Plz Help ?

Hi all

Well fellowz, i am very thankfull for all your help in the past and i hope you guys will help in future as well. Here is a scenario that i want to discuss..

Suppose a person is earning £50K/year as a full time employe in an IT company in UK on Tier 1 G status (applied after 05-April-2010). After spending 1yr & 3 months (out of his initial 2 yrs in uk) of unemployement in uk, that person started his fulltime job only 9 months before his Tier 1 G (2yr and then 3yr ext program) visa expiry date.

His monthly salary would be around £4166.6/month before Tax Deduction and for 9 months his salary would become around £37500 before Tax Deduction. Now my question is which salary band he should select from PBS to claim the points for his earnings ?

Should he select a band from £35,000 - £39,000 or should he select the band from £50,000 - £54,000 ?

Please clarify this scenario at your earliest convenience.. anxiously waiting for your expert views about this scenario.

The amount earned in Last 12 months should only be selected if only 37000 is earned then the band 35000-39000 should be selected.
