VISA ADVISE from Tier 4 dependent to Tier 2

Greetings. I have some questions regarding switching.

I am switch my Tier 4 dependent to Tier 2(SOC 3132 or 3131) I have few question about tier 2 Can any one please advise me ?
1. Can I apply under any of SOC 3132 or 3131? I mean are they in Shortage Occupation List. I do not think both job in Shortage Occupation List.
2. My company has advertised Jobcentre more than 3-4(60+days) times no suitable candidate so far but no advertisement in any of newspaper.
3. All the Advertisement made under sister company not actually REGISTER SPONSOR. What do you think it will be issue ?
4. Do I need do clear any English exam ( I already have IELTS which I passed in 2006.
