Visa fee for Step-Child of EC National?

Visa fee for Step-Child of EC National?

I am a UK national, my wife, son and step daughter all have Mozambican passports. We outside of Europe, in the same house as a family and both the children are my dependants.

When applying for a schengen tourist visa, the fee for my wife and son was waivered (as spouse / decendant of an EU national), but the issuing embassy insisted that my step daughter had to pay the €60 fee.

Is this correct? I am sure that I have seen EC legislation somewhere that states that both my direct descendants and those of my spouse could / should be waivered.

Grateful for any clarification

Article 5(2) of Directive 2004/38/EC states that family members shall be isued a visa for free. Article 2(2c) defines as family members among others direct descendants under the age of 21 or dependants including those of the spouse or partner.
