Visa for Spouse to Be

Hi,

I am from Pakistan and came here on HSMP Visa in Jun 2006. I started my job on HSMP visa in July 2006. I am engaged to Pakistani girl and will soon be getting married in Jan 2007.

I am living in a shared accomodation here where I have one room for myself. I want her to come with me when I come back in 2007 after I get married in Pakistan.

I have two questions here.

1) What is the possibility for her to get the visa so that she can come with me in Jan 2007 if I we get Nikkah (legal marriage) over telephone?

2) What if she applies for Fiance Visa? will she be able to come here with me in that case?

Please also let me know which is better and feasible in my case? and Who should apply for visa I (from here or she from Pakistan).

1. When this telephone "marriage" takes place, where will you be? In the UK? If that is the case you need to have a good read of this IND document, which is part of the instructions given to staff dealing with visa applications. In particular read 3.2. You also need to be in Pakistan, or some other country that permits telephone marriages, when that telephone marriage is conducted. If you are in the UK then it will not be recognised as a valid marriage by the UK, given that telephone marriages are not permitted in the UK.
2. She cannot apply for a fiancée visa given that you are not "settled" in the UK. You say you have a HSMP visa. If you had ILR then it would be different.

The visa application for your wife (as she will then be) needs to be made by her in Pakistan, not by you in the UK. But you will need to provide information in support of the application.
