I hold a UK PSW Tier I visa and have been in the UK for the past 1 year. I am an Indian citizen.

My wife is a Malaysian citizen, currently residing in Malaysia. She has been in Malaysia ever since I reached the UK last year to pursue my studies.

My question is - can she apply as a dependent in the UK or will she have to apply in Malaysia?

unless she currently holds valid entry clearance/leave to remain which permits her to switch to the partner of a Tier 1(PSW) migrant then she will have to apply from Malaysia and not the UK.

Note that if you have not lived together since you have been in the UK studying then you will need to provide evidence that your relationship is subsisting.

Thank you Greenie. Would her visit to the UK last Dec for nearly a month constitute as a proof of a subsisting relationship?
