Hi,
I was requested to resubmit my dissertation from.my University by 15th January 24. Unfortunately my visa expires 27th Jan. My department informed me that my results will be published by 26th Feb. I requested for a new cas but they refused. Also they refused to do adjustments in early release of my results or even submission of the dissertation. I would like to know what can be done in this case. Please help

Is your university willing to offer a graduate visa if you pass? If not, then you need to look at another visa route before the expiry of your student visa expires.

Why did they refuse to issue a CAS? This would be their choice, so I hope they are not hiding behind Home Office rules saying they are not allowed to.

I think university cannot decide about graduate as they are not providing graduate visa. Results won't be published within the date of visa expiry.

Hi have seen your comments in many other cases in this platform. Visa department of the university refused such possibility of getting cas and all.
I had a meeting with my hod today he said he will check the possibility. Can you help with the requirements of extending visa with new CAS if they issued. Before how many days I should apply. Do you have any link from gov.uk saying about giving CAS on resits for universities. I couldn't find any documents on CAS and such things. If you have anything of that sort I can forward it to my HOD

It's the visa compliance people who decide, not your Head of Department. If they will not issue a CAS, they need to explain why not, and show you either the university policy on that, or where Home Office rules or guidance do not allow it, if that's what they are (wrongly) saying.

Also contact the students union at your university and explain your situation. It's almost certain that they have dealt with similar cases with other students. But you need to do that now - if not done yet, they might be disappearing by the end of this week and returning in the new year.

They didnt say any specific reason but what they said was we cannot provide inorder to wait for results. Can I know if I need to apply extension using CAS letter, by what I must apply. Did you apply before like this.

I contacted graduate students union. They said to apply complaint and they no much of clarity.

Thank you for the reply. I have a few doubts. Suppose if I get a new CAS letter. Is there any date that I must apply visa extension? I 'heard' before 28 days of expiry of current visa.
Could you provide any uk gov documents about this so that I can argue with them.

You could encourage them to speak with UKCISA, the UK Council for International Student Affairs, who provide advice on visa matters to both students and universities.

You can apply for a new visa right up to the date of your current expiry date.
There is nothing in Home Office guidance that compels an educational sponsor to issue a CAS. The sponsor decides whether they wish to issue an extension CAS for your circumstances. If they do not wish to do unless they have a stated policy on their position there is little to argue against.

On top of the other advice, I don't know if you have done all these queries to the university (including the students union) via email or in person, but try to speak with them in person - if possible. I've seen that some students didn't get a solution to their issues until they have a face to face meeting with someone. Need to emphasise to them that you have to complete your studies in the UK as it's your desire to apply for the graduate visa.

But submission of my dissertation is before expiry of my visa. That's why would like to know exactly at what time should apply for Extension if I got new visa

Everything is through online except with my HOD. As you advice, I'll definitely make a face to face discussion.

You can apply for a visa extension at any time before your current leave expires, there's no such thing as a 28-days rule for this. Solicitors can give any random advice as they're just trying to get clients, always check guidance from official sources.

Thank you. Also during resubmission of Dissertation, it is mandatory to stay with 20 hours work right. How do they create term time and off term time after 1st submission to 2nd submission.

As long as your university has issued a CAS, which they can only do if the
course has not finished, which will be some time before the expiry date of the visa.
Once you have a CAS, you can apply any time on or before the date the visa expires.

That's a question for your university, but it is term-time until you have completed the course according to the new end date.

The university checks that you are eligible to apply, based on your qualification and on your compliance with your Student visa conditions.
Separately, the application asks if you have ever worked without permission to do so, so that is your chance to explain any mistaken working more than the 20 hours a week allowed.
