L1 Visa Query

I worked for employer X from Feb'03 to Mar'04 totalling 13 months. I have been with my current employer since then i.e. totalling 6 months.

According to the rules, L1 visa applicant must have worked with the overseas company for 1 year out of last 3 years preceding the transfer.

Now can my ex employer file for my L1 visa ?
