Can you please suggest me what documents need to produce in appeal as evidance and judge accpet missing documents or evidance like if i provide director's loan agreement which was missing and look again comapny accounts from accountant and correct according to policy guidance.

I also have prove of investment like invoice, bank transctions showing investment has made and provided HO in with my application.


Please tell me what are my chances to win appeal and what documents need to submit in appeal.

@ hnav, I have already given my opinion on your appeal in my earlier post;


@ hnav,

I am of the opinion that your appeal has a very high chance of success, but the best option is for you to have an alternative plan in place by making necessary plans for new application should in case the appeal turn otherwise.

You should concentrate on drawing the attention of the judge to the fact that you have already spent £1200 on your business with documents and the rest of the funds are in your personal account.

I think that you should also get a lawyer to notarize your Director's loan agreement to make it a legal document as the refusal points to the fact that your accountant is not accepted as a legal representative to certify the director's loan agreement.

You should also get all the documents necessary and take with you to the appeal hearing as the judge might accept them under evidential flexibility because the director's loan agreement is one missing document from series of your investment documents.

Just update you i had provided charterd accountant latter as well. That accountant is fullfill all the requrments of HO as legal rep. He made accounts and produced a letter in which he wrote investment made directly in my own name also wrote dates of investments and amonuts and in company accounts shown two trans clearly and one is not showing clear. That one tran is in other company expenses

In refusal they said accountant letter unacceptable, accounts not showing clearly investment made and director 's loan agreement not provided

In this case we can fight that accountant is legal rep and fullfill all requrments and policy guidance says accountat certificate must provided and we provide

@ hnav, you should not argue about accountant being a legal representative because that's not the case, you should focus more on arguing that HO should have requested for additional investment evidence under evidential flexibility as you have submitted some from the required list.

check this link;

‘Legal representatives’ are defined as persons authorised under the Legal Services Act 2007. While this does encompass solicitors and barristers, it does not include accountants and tax advisers who are not also legally qualified.
