K-3 Visa?

Post by tuchabf » Wed Jul 30, 2008 7:18 am

I have been in the usa for 5 months in a turist visa. My 6 months is getting over, and I am going back to Brazil, my home country. I met my bf when I arrived here, and we having been thinking about getting married.

At first, we thought about getting married here on court, and while I am in Brazil, I would organize the major event, and he would go there for the religious cerimony.

Would the k-3 visa be the best one for us? or k-1? or some other? My turist visa is valid till 2010, should I just come here after the cerimony using it and then change my status? Should I marry in the court in US or Brazil? We dont want to be apart for too long, so what would be best choice for us?

Please, some "enlightment" will be extremelly appreacited!!

Thank you thank you!!!

From what I've heard the K3 is apparently not worth the effort. You are probably better off applying for an immigrant visa if you decide to marry in Brazil. If you decide to get married in the US you should use a K1 visa. It's illegal to enter with a tourist visa with the intent to get married and adjust status.

You may want to ask in the following forum on US marriage based visas:
