Visit Visa Refused! Questions about it and about Appeal

Post by abbas_ali » Sun Aug 29, 2010 2:20 pm

Hi all,

My uncle and grandmother's visa was refused. I think our case was pretty decent, just his age is young (in his mid 20's) and they may have been extra strict. It was refused on requirements 41 (vi) (vii), 41 (I)(ii) and 41 (I) (vi).

The refusals were as follow:
. "On your application form you have stated you wish to visit your nephew and sister and they will assist you with your travel costs, support and accommodation. However you have presented no satisfactory evidence from them so show that they are able to do so. Whilst I note an accountant's letter states 'we have been informed Mr Ali receives £xxxx per annum' no satisfactory evidence of such income has been presented. Neither have you provided details of his personal or financial commitments. Secondly, you state that your father will contribute towards the cost of your visit but again you have provided no satisfactory evidence of his employment or income i.e. tax documentation, personal bank statements etc. Whilst some land documents have been presented these do not shown income earned. I am not satisfied that you will maintain and accommodate yourself and any dependents adequately out of the resources available to you without resources to public funds or taking employment; or will, with any dependents, be maintained and accommodated adequately by relatives or friends. Finally I am not satisfied that you can meet the cost of the return or onward journey. 41(vi)(vii)

. On your application you have stated you earn nearly Rs xxxx per month however you have presented no satisfactory evidence to confirm this. The tax documentation you have presented is readily available in Pakistan for self completion and are effectively a self declaration of circumstances. Furthermore your stated income is not reflected in your bank statement where the only deposit is for Rs xxxx (much higher than wage) which you claim is from your father, although you have not provided evidence of this. As a result I am not satisfied your personal circumstances are as you have indicated. This also means I am not satisfied as to your intentions in wishing to travel to the UK now. I am not therefore satisfied that you are genuinely seeking entry as a general visitor for a limited period as stated by you, not exceeding 6 months, nor am I satisfied that you intend to leave the United Kingdom at the end of the period of the visit as stated by you. 41 (I)(ii)

. I note that you propose to spend 8 weeks in the UK. It is unclear as to how you will maintain your business and family in Pakistan or indeed yourself in the UK during this extended absence. You have failed to show satisfactory evidence of your employment, income and assets in Pakistan which lead me to doubt that you are genuinely seeking entry as a visitor for a limited period as stated by you, not exceeding 6 months. I am furthermore not satisfied that you are able to maintain and accommodate yourself and any dependants adequately out of resources available to you without recourse to public funds or taking employment. 41(i0(iv)"

The documents I submitted were as follows: UK passport photocopy, 6 months bank statements, 3 months’ payslips, letter from accountant, supporting letter from my mum's GP that she cannot visit, council tax bill, home ownership papers and sponsorship declaration.

To be honest, I am unsure of exactly what paperwork my grandmother and uncle submitted but it was certainly bank statements, evidence of my grandfather's property ownership, evidence of my uncle's business and earnings although they have deemed this unsatisfactory. What bugs me is I have not provided satisfactory evidence of my income according to them but I provided the letter from the accountant which as they correctly say alone is not enough, but I submitted wage slips as well as bank statements.

If anyone can advise on how we should appeal that would be so helpful. Also some guy has approached my relatives in Pakistan and says he will do an appeal for 1500 rupees (which is peanuts). I believe most of these guys are crooks and at 1500 rupees he must be. Regardless, is it the procedure that only I can launch the appeal from over here?
