visitor overstayed in uk help needed

my uncle went to uk as a visitor.now he is illeligal overthere as his visa expired in july 2007.now he is ill there.he wants to come back to home country and after medical treatment he again want to go UK what should he do?

My advice is for him:-

Go home before 1st October 2008, get treated and well enough to return to UK and apply again. Beware - if he overstayed on a visitors visa he is unlikely to a visitors visa granted again, even with the concession in place at the moment. They can rely on the rule that he should not be in the UK for more than 6 months out of 12 so would not entertain another visitors visa for at least 6 months after his departure from the UK.

Is this the same uncle that is sponsoring you? If so your visa application is likely to fail because he will not be deemed a suitable / trustworthy sponsor because of his own failure to return.

firstly he is not the uncle who is sponsoring me but i want to ask that in his first visit to uk he left the countary b4 6 months .but its the second time that he went to uk and overstayed there.and what about if he leaves UK now should he be allowed to enter again ?

secondly can my uncle sponsor my family too for student dependent visa ?
