I want to apply for ILR, what about my partner?!?

Post by higrade61 » Mon Jun 20, 2011 3:16 pm

Hello Everyone!

I came to the UK under Work Permit visa from May2006 on. My partner came over as Work Permit Dependant on July 2010 (his visa expire date was exactly like mine). Then we got married on January 2011.

Since I was late in moving to the UK, my visa were about to expire before I finish 5 years working in the UK, So we both applied for 2 years TIER 2 EXTENTION VISA.
Hopefully we received our passports today and we noticed that we will receive our ID CARDS (it’s a new doc I guess) after some days.

NOW since already I finished 5 years living in the UK, I want to apply for my ILR visa IN PERSON (not by post). I have some questions:

1- What category me and my partner should apply?
Since my partner has been in the UK from last year (although we are in relationship for 4 years), I guess he is not eligible to apply for ILR.

2- Can we do the applications and make the appointment together (even if our category is different)?

:?:
Thank you very much! I hope you can be able to help me.

1. Your partner is not eligible for settlement as yet.
2. No.

I saw somebody told that they sent their applications seperately but in the same time and they included covering letter which explained that we can do the FLR for the partner after my visa were granted. what do you think?

1. When do you become eligible to apply for settlement?
2. When does your partner's current (Tier 2) leave expire?

Since I finished my 5 years period, I am already aligible for applying for settlement.
My partner has a Tier2 Dependant Visa untill 2014. But since the immigration rules are going to change, we want to do all the procidures asap.
