I want to challenge the 20 year long residency, need help.

After the rules on long residency changed from 10 year to know 20 years for unlawful residency, has anyone challenged the UKBA, high court or Supreme Court on this rulling.

I have lived in UK for 12 years now (7year lawful) and still awaiting for an answer on my asylum application. When the ruling changed for teh 10 year long term residency I was short by one year.

Now after living in any country for more than 10 years, you would have the right to say you are now part of the country you are lving in, UK. What i mean by this is, you have addapted to the culture, society and the ways of living and how the system of the country works, you have worked, paid taxes. built a network of work collegues, made friends which you can consider them as family and as time goes on, you tend to know talk and behave like a person who has livind in UK all their life.

For those who are living here unlawfully or awaiting a decision from the Homeoffice and have lived here for more than 10 years will be in limbo, you will have no identity, no pupose and no structure in life and don't know what tomorrow may bring you.

"The new long residence requirement of 20 years has also been set as a benchmark for establishing private life in the UK".. i say living in any country for more than 10 years should be a benchmark for a private life[/u]

I would like to challenge this ruling of the 20 year unlawful residiency. and as much for me but for many out there would like you start living your life and have some future.

I need your help to do this.

Just to clarify, the 10 year lawful long residency rule has not be changed substantially. What has altered is that the 14 years continuous residency rule (which allowed for legal and illegal stay) has been extended to 20 years.

So, as you can see, if your legal stay has been broken, you would not qualify even under the old rules. But assuming that the asylum application was filed before your "7 years lawful" stay expired, you may still be eligible to apply under the 10 year long residency rule.

Home Office guidance on long residence

To assist you further, can you provide more details of your legal stay (which visa/s and when were they granted)? And what were the grounds of your asylum application? Given that your asylum application appears to have been outstanding for 5 years, have you chased your solicitor? And have you involved your MP?

For me, illegal stay is just that, stealing. I do appreciate that over time some rights to stay must be automatically conferred - I know I get stick here but I don't want see people sent to a place they just happened to be born in and do not know anymore. But, I still feel people should not profit from illegal activities.

Just my feeling - I have no answer and a lot worse goes on in the World so I dunno!

For me it's schism, rather like Raskolnikov in Crime and Punishment, mixed up feelings/opinions.....
