what chances do i have

Post by sandrine16 » Tue Mar 23, 2010 7:53 pm

I'm thinking of applying on the ground that we've been here for a while and the children are studying well and already have plans for uni later. we don't have any criminal records. I've been able to support myself and children for that long. we have build up our friendship here.
In my home country we have no one to go, no house, the children don't know anybody. I'm an orphan. The children father lives here but don't contribute a penny for the children he is with someone else.
If we stay at least i can send him to court for maintenance of his own children as he is working. and also the children will have a better life here as this is the only home they have and know.

I would like to apply for discretionary leave on the ground that i've been in the country for 6yrs have 2 dependants in full time education. No criminal records i have been able to support myself and the children for that long. The children seems settle and are happy to be here. They have friends. any advice welcome. Given your reasons... next to ZERO! You should have really good reasons as to why you cannot return to your home, and apply through the proper channels. Children being 'happy and settled' and having 'no criminal record' is not good enough, I'm afraid! :(

Ok. I've just noticed that the children's father is in the UK! If he's there legally, then perhaps you could ask him to apply for "access to the children", so that you cannot remove them from the UK. But given that you say he doesn't bother with them right now, I wonder how you will manage that...

What is father status? Very important question in your case...Otherwise you have zero chance.

In mu view you have no chance. There 7 years policy for childern is also withdrawn so this option is not available now.
These are my personal views only please.
