what is my husband chance of getting a entry visa for the uk

Post by MISSTP » Thu Mar 23, 2006 8:50 am

hi there i don't know where to start so i will tell you from the beginning i meet my husband in 2002 when we was both studying he came over to the uk as a vistor from st lucia and then he applied for a student visa he was refused the visa because of the college he was going to he then change his college and applied for another student visa in 2003 but this time a solictor helped him with the application we got married in november 2003 and gave the solictor all our details to send to the homeoffice he didn't send them in and only in september 2005 my huband got a reply back from the homeoffice that the student visa was refused but he had the right to appeal.
we change the solictors that we had and the new solictor told my husband to voluntary return to his country in order to re-apply for re-entry clearance to join his spouse in the uk.
his solictors put his application together with all the details needed.
we both return to his country to try and fix this situation but i am now back in the uk and he has not heard any thing from them it's been 2 weeks but the processing time is 10 days in barbados british high commission.
what is his chance of getting this entry visa being he has such a bad immigration history and would they take in to consideration that we have been married for 2-1/2 years.

what is his chance of getting this entry visa
That depends upon the quality of the supporting evidence. Can you detail what was provided in support of the application?
he has such a bad immigration history
If you look at posts on this board you will find quite a few examples of people who have a far worse immigration record than your husband ..... and ended up getting their spouse visa. He has done the right thing ... gone back to his country and applied for the spouse visa there. Hopefully he will hear soon about his application.

and the solicitor added his immigration history and that is all he said we needed.

rent agreement
That is the only thing I can spot about accommodation. Was there any evidence to show the place is "suitable" and certainly not overcrowded?

Also the rental agreement ... in your name? If so, from its terms is it clear that your husband can live there? Or if not, a letter from the landlord/agent confirming that he can?

Ok in the application it ask you how my rooms you have in the accommodation i have 6 rooms in my flat living room, Spam, bathroom and 3 bedrooms it also say this on the tenancy agreement is this ok.

Yes my name is on the agreement but i don't have anything saying he can live with me but we have been living in this flat for a year now and his home office letters has the flats address and has been coming to the address with my husbands name on them
would they be satisfied with them.

I think that should be OK, especially as it can be seen that he has already been living there for a while, and now just needs permission to return.

Size of property clearly OK.
