What is "Limited Leave to Remain"

Post by thangvan » Tue Jul 31, 2007 5:50 pm

Dear all, I am vietnamese citizen (visa national) and now a student in the UK. I used to have an entry clearance on my passport but they were stolen. I have just got a new passport and a "Residence permit" from the Border and Immigration Agency( Type of Permit: Leave to Remain). It is valid until the end of 2008.

I am wondering if it allows me to enter the UK. I want to go home for a month in Sept and go back here to finish my course but i dont know if it is ok for me to use my new stamp to enter the UK. Help me please!!

It should say 'MULTI' on it somewhere if I can picture my gf's correctly....Means multiple-entry of course...

No mate, it does not have any "multi", and there is nowhere I can find specify option for "Entry".

As in my lost entry clearance, it says: Number of Entries: MULT

but there is no such thing in my new stamp

All residence permits issued by the Home Office within the UK are multiple-entry visas that allow you leave and re-enter the UK as many times as you like during the validity of the visa.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

That's right - if the initial leave to enter or remain was for more 6 months, then the leave does not lapse when you leave the UK. So you can leave and come back again on your visa while it remains current.

See the immigration rules, item 20A (Non-lapsing leave), at this web address, which says - note the second sentence:
Leave to enter or remain in the United Kingdom will usually lapse on the holder going to a country or territory outside the common travel area. However, under article 13 of the Immigration (Leave to Enter and Remain) Order 2000 such leave will not lapse where it was given for a period exceeding six months or where it was conferred by means of an entry clearance (other than a visit visa).
So it is fine for you to go home for a month and then return, as you propose.
